These Terms govern your use of the P3 communications GmbH software development kit (“P3 SDK”) and any applications, services, platforms, or solutions in which the P3 SDK is integrated (“App”), whether operated by P3 communications GmbH, its affiliates, or third-party providers. By accessing or using such applications or services, you agree to these Terms.
1. Scope
These Terms govern the use of the App and any services, features, content, software components, software development kits (“SDKs”), and related technologies made available through the App. The App may include software and services provided by third parties, including technology supplied by P3 communication GmbH (“P3”).
2. Eligibility
The App and integrated SDK are not intended for children below the applicable age of digital consent under relevant law. You must be at least eighteen (18) years old or the age of majority in your jurisdiction to use the App.
You represent and warrant that you have the legal capacity to enter into these Terms.
If the Provider becomes aware that such data has been collected inadvertently, reasonable steps may be taken to delete the information.
3. Description of the App
The App provides functionalities, information, services, and features determined by the Provider from time to time.
Certain functionalities may rely on the collection and analysis of technical performance, connectivity, or usage information through integrated technology components, including the P3 SDK.
The scope and availability of App features may vary by device, operating system, network operator, and geographic location.
4. SDK Integration and Measurement Technology
4.1. The App incorporates software components provided by P3, including the P3 software development kit (“P3 SDK”).
The P3 SDK may support processing of data for the following purposes:
- Network & signal quality → Information about the mobile or Wi-Fi network your device is using – for example: network operator, radio technology (e.g., 4G/5G), signal quality, connection speed and stability, and cell identifiers broadcast by nearby towers.
- Voice call quality (metadata only) → Technical information about voice calls, such as start/end time, duration, network technology used, and any switch between networks during the call. We do not access phone numbers, contacts, or the content of the call.
- Data usage (aggregate volumes) → Total bytes sent and received by your device on mobile and Wi-Fi, taken from the operating system’s built-in counters. We do not inspect the traffic itself.
- Location → Where you allow it, we collect location information (latitude/longitude and, where available, a coarse geospatial index). Location is used to place network measurements on the map. You can turn it off at any time in the App or in your device settings.
- Device context → Basic device information (manufacturer, model, OS version), battery status, memory and thermal state. This helps us interpret measurements correctly and detect abnormal readings.
- A pseudonymous identifier → A random identifier generated on your device. It is regularly rotated and cannot be used on its own to identify you.
The App Provider and P3 reserve the right to modify, update, suspend, limit, or discontinue SDK functionality at any time without prior notice.
Certain measurement activities may occur automatically while the App is operating.
4.3. Device Resources and Connectivity
The User acknowledges that the App and any integrated SDKs may utilize device resources, including processing power, storage capacity, battery consumption, and network connectivity, to provide the intended functionality, measurement services, diagnostics, analytics, and related features. Such resource usage shall be limited to what is reasonably necessary for operation of the App and associated services.
4.4. Mobile Data and Network Charges
The User is solely responsible for any fees, charges, or costs imposed by telecommunications providers, internet service providers, or other third parties arising from use of the App, including mobile data usage, roaming charges, messaging fees, and internet access costs.
5. User Consent
By using the App, you acknowledge and agree that technical, device, network, connectivity, performance, and usage information may be collected and processed as described in these Terms and the applicable Privacy Policy.
Where required by applicable law, the Provider will obtain any necessary consent before processing personal data.
6. Data Collection and Processing
6.1. The App may collect information including:
- Device information (manufacturer, model, OS version), battery status, memory and thermal state;
- random identifier generated on your device;
- Information about the mobile or Wi-Fi network your device is using — for example: network operator, radio technology (e.g., 4G/5G), signal quality, connection speed and stability, and cell identifiers broadcast by nearby towers. Connectivity and signal quality information;
- Technical information about voice calls, such as start/end time, duration, network technology used, and any switch between networks during the call (metadata only);
- Total bytes sent and received by your device on mobile and Wi-Fi, taken from the operating system’s built-in counters (aggregate volumes);
- Application performance metrics;
- Technical diagnostics;
- Error and crash reports;
- General usage statistics;
- Geographical information (latitude/longitude and, where available, a coarse geospatial index);
- Other technical information necessary to provide, maintain, and improve the App.
The categories of personal data, purposes of processing, retention periods, legal bases, recipients, and user rights regarding the processing of the App from the App Provider are further described in the Privacy Policy.
6.2. What We Do NOT Collect
For the avoidance of doubt, the P3 SDK does not collect or access the content of communications, including telephone conversations, messages, emails, photographs, contacts, browsing history, passwords, or similar user content. The SDK is designed solely to collect technical measurement and performance-related information.
6.3. Aggregated and Anonymized Data
The Provider and P3 communication GmbH may create, generate, process, use, retain, commercialize, license, publish, distribute, and otherwise exploit aggregated, anonymized, statistical, benchmark, analytical, and non-personally identifiable datasets derived from the operation of the App, the SDK, and associated services. Such datasets shall not identify individual Users and shall remain the exclusive property of P3 communication GmbH and its affiliates.
6.4. Benchmarking and Research Activities
The User acknowledges and agrees that aggregated and anonymized information derived from measurements performed through the App may be incorporated into market studies, benchmarking reports, research publications, industry analyses, performance assessments, academic research, artificial intelligence models, and other commercial or non-commercial outputs produced by the Provider, P3 communication GmbH, or their affiliates.
6.5. Use of Affiliates and Service Providers
The Provider and P3 communication GmbH may engage affiliates, subcontractors, cloud service providers, hosting providers, infrastructure partners, analytics providers, and other service providers for the development, operation, maintenance, support, hosting, storage, processing, and improvement of the App and related services.
6.6. No Advertising / Profiling / Sale of Data
Neither the Provider nor P3 communication GmbH sells personal data or uses personal data collected through the SDK for targeted advertising, behavioural advertising, individual profiling, or marketing purposes.
6.5. Data Retention Framework
Personal data and measurement information shall be retained only for as long as reasonably necessary to fulfil the purposes described in these Terms and the applicable Privacy Policy, after which such information may be deleted, anonymized, or aggregated.
7. Privacy
7.1. The processing of personal data is governed by the applicable Privacy Policy, which forms an integral part of these Terms.
Users are encouraged to review the Privacy Policy carefully before using the App.
To the extent required by applicable data protection law, including the GDPR, users may exercise their rights in accordance with the procedures described in the Privacy Policy.

7.2. Consent Withdrawal and Control Options
Where processing activities are based upon User consent under applicable law, Users may withdraw such consent at any time through the controls provided within the App, device settings, or other mechanisms described in the Privacy Policy. Withdrawal of consent shall not affect the lawfulness of processing performed prior to such withdrawal.
7.3. Security Commitments
The Provider and P3 implement reasonable technical and organisational security measures designed to protect collected data against unauthorised access, disclosure, alteration, or destruction, including encryption, access controls, and privacy-by-design practices where appropriate.
7.4. International Data Transfer
Where personal data are transferred outside the European Economic Area or another jurisdiction requiring transfer safeguards, such transfers shall be conducted in accordance with applicable data protection laws and appropriate transfer mechanisms.
7.5. Data Subject Rights Contact
Requests relating to privacy rights, including access, rectification, erasure, restriction of processing, objection, portability, or consent withdrawal, may be submitted through the contact channels identified in the Privacy Policy or the contact details provided in Section 18. Additionally, you have the right to lodge a complaint with a supervisory authority.
8. Intellectual Property Rights
8.1. All rights, title, and interest in and to the App, SDKs, software, methodologies, algorithms, databases, benchmarking frameworks, analytical models, measurement systems, know-how, documentation, logos, trademarks, reports, and related technologies are and remain the exclusive property of the Provider, P3, and their respective licensors.
8.2. All aggregated, anonymized, statistical, benchmarking, measurement, analytics, market intelligence, and derived datasets generated through operation of the SDK shall remain the exclusive property of P3 communication GmbH. No rights in such datasets are granted to users except as expressly provided in writing.
8.3. No ownership rights are transferred to users.
Users are granted a limited, non-exclusive, non-transferable, revocable right to use the App solely for its intended purposes.
Except as expressly permitted by mandatory law, users shall not:
- Copy;
- Reverse engineer;
- Decompile;
- Disassemble;
- Modify;
- Create derivative works from;
- Circumvent security mechanisms of;
- Redistribute or resell;
any part of the App or the P3 SDK.
8.4. Open Source Software
The App may contain or incorporate open-source software components that are subject to separate license terms. Such components remain governed by their respective open-source licenses, and nothing in these Terms shall restrict the User’s rights under any applicable open-source license.
9. User Obligations
9.1. Users agree to:
- Use the App in compliance with applicable laws;
- Provide accurate information where requested;
- Not interfere with App functionality;
- Not attempt unauthorized access to systems or networks;
- Not use the App for fraudulent, unlawful, or abusive purposes.
Any misuse may result in suspension or termination of access.
9.2. Device Integrity and Security
Users shall not interfere with the operation or security of the App, the SDK, or associated services. Users further agree not to use the App in connection with modified, rooted, jailbroken, compromised, or otherwise altered devices in a manner that could adversely affect the security, integrity, or functionality of the App or related systems.
10. Third-Party Services
10.1. The App may contain integrations, data sources, or links to third-party services.
The Provider is not responsible for the availability, content, security, or operation of third-party services.
Use of such services is subject to the applicable third-party terms and policies.
10.2. Beta and Experimental Features
Certain features, functionalities, services, analytics capabilities, or measurement technologies may be designated as beta, preview, evaluation, test, pilot, or experimental features. Such features may be modified, suspended, restricted, or discontinued at any time without notice and may be subject to additional limitations or performance issues.
11. Availability and Changes
11.1. The Provider may:
- Modify App features;
- Introduce new functionality;
- Remove functionality;
- Suspend services;
- Discontinue services;
at any time and without liability.
The Provider does not guarantee uninterrupted or error-free operation of the App.
11.2. Measurement and Analytics Disclaimer
Any measurements, benchmark results, statistics, performance assessments, service quality indicators, analytical outputs, reports, scores, rankings, insights, recommendations, or other information generated through the App or SDK are provided solely for informational purposes. Neither the Provider nor P3 communication GmbH guarantees the accuracy, completeness, reliability, regulatory compliance, or commercial suitability of such information. Such information shall not constitute professional, regulatory, technical, investment, or business advice.
12. Disclaimer of Warranties
To the maximum extent permitted by law, the App, SDKs, services, reports, measurements, and related content are provided on an”AS IS” and”AS AVAILABLE” basis.
The Provider and P3 make no representations or warranties regarding:
- Accuracy;
- Completeness;
- Availability;
- Reliability;
- Fitness for a particular purpose;
- Non-infringement.
Users assume all risks associated with use of the App.
13. Limitation of Liability
13.1. To the fullest extent permitted by law, neither the Provider, P3, nor their affiliates, officers, directors, employees, contractors, licensors, or partners shall be liable for:
- Indirect damages;
- Incidental damages;
- Consequential damages;
- Special damages;
- Exemplary damages;
- Punitive damages;
- Loss of profits;
- Loss of reputation;
- Loss of data;
- Business interruption.
13.2. The aggregate liability of the Provider and P3 arising out of or relating to the App shall not exceed the amount paid by the user for use of the App during the preceding twelve (12) months.
Nothing in these Terms excludes or limits liability for:
- Fraud;
- Fraudulent misrepresentation;
- Wilful misconduct;
- Gross negligence where not legally excludable;
- Death or personal injury resulting from negligence;
- Any liability that cannot be excluded under applicable law.
13.3. Export Control and Trade Compliance
The User shall comply with all applicable export control, sanctions, embargo, and trade compliance laws and regulations. The User shall not access, use, export, re-export, transfer, or make available the App in violation of any applicable trade restrictions or sanctions requirements.
14. Indemnification
14.1. Users agree to indemnify and hold harmless the Provider, P3, and their affiliates from any claims, losses, damages, liabilities, costs, and expenses arising from:
- Violation of these Terms;
- Violation of applicable law;
- Unauthorized use of the App;
- Infringement of third-party rights.
14.2. Force Majeure
Neither party shall be liable for any delay, interruption, failure, or inability to perform its obligations under these Terms to the extent caused by events beyond its reasonable control, including acts of God, natural disasters, pandemics, telecommunications failures, internet outages, cyber-attacks, governmental actions, labor disputes, war, civil unrest, or failures of third-party service providers.
15. Suspension and Termination
The Provider may suspend or terminate access to the App immediately if:
- Users breach these Terms;
- Use of the App creates security, legal, or operational risks;
- Required by law or regulatory authority.
Termination does not affect accrued rights or obligations.
16. Changes to These Terms
16.1. The Provider may amend these Terms from time to time.
Updated versions will be made available through the App or other appropriate channels.
Continued use of the App after amendments become effective constitutes acceptance of the revised Terms.
16.2. Electronic Communications
The User agrees that the Provider may provide notices, disclosures, updates, legal communications, and other information electronically, including through the App, email, websites, push notifications, or other digital communication methods. Such electronic communications shall satisfy any legal requirement that communications be in writing.
16.3. Material Privacy Changes Notice
Where material changes affect the processing of personal data, the Provider may provide additional notice through the App and, where required by law, obtain renewed consent.
17. Governing Law
17.1 Governing Law.
These Terms shall be exclusively governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
17.2 Jurisdiction
To the maximum extent permitted by applicable law, all disputes arising from or relating to these Terms, the App, or the integrated P3 SDK shall be exclusively resolved by the competent courts of Stuttgart, Germany.
17.3 International Use
The App and the integrated P3 SDK may be made available and used in multiple jurisdictions worldwide. Users acknowledge that processing activities may be performed by P3 communications GmbH and its affiliates from Germany or other locations in accordance with applicable data protection and cross-border transfer laws.
17.4. Assignment
The Provider may assign, transfer, novate, subcontract, or otherwise dispose of its rights and obligations under these Terms, in whole or in part, to an affiliate, successor entity, purchaser of business assets, or other third party without requiring User consent.
17.5. Severability
If any provision of these Terms is held invalid, unlawful, or unenforceable by a competent court or authority, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
17.6. Entire Agreement
These Terms, together with the Privacy Policy and any documents expressly incorporated by reference, constitute the entire agreement between the User and the Provider concerning the use of the App and supersede all prior discussions, understandings, representations, and agreements relating to the subject matter hereof.
